EP 1280 When hiring, are you allowed to deny people on a bad personality?

Summary

"When hiring, are you allowed to deny people on the bad personality where, if they don't embody the company image, even if they meet the paper requirements."
I want to break this question down into a couple of different components.  The basis of the rejection is your personality, not whether you have the skill… The company image… I'm confused about that but I will try to sort through as I talk.

Discrimination exists, under US law, based upon a number of criteria.  Some states have added additional criteria onto the initial federal wants.  As long as the form of discrimination. Any of those laws, it is not, by definition, discrimination.  It may be discriminatory. It may reflect ignorance, but it is not legally discrimination.

In this example, a person meets the paper requirements and we don't know whether this person displayed their knowledge poorly on the interview.  We are just going to look at what we know here.  This person believes that they were turned down based upon personality and a 2nd criteria.

Personality is not a discriminatory category under any criteria I've ever heard of.  Firms are allowed to evaluate people for "fit" as long as that doesn't fall into a discriminatory category.  For example, we don't think you fit in because we only hire men.  Another example would be your gay and we only hire heterosexuals.  And, of course you are black and we are white or your white or black.  What do you know about our culture without actually giving them a chance to demonstrate that in the course of the interview?  That would be clear discrimination based upon it. Personality… No.

Company Image?
I had a question based upon the phrase, "the company image."  They don't embody "the company image."  I'm wondering whether this is a question about weight and whether this person might be profoundly obese, for example.  In certain states, that behavior might qualify as discrimination.

Ultimately, you have to prove that was the criteria for being rejected by this organization.  That is a hard road to take.  In terms of weight, to my knowledge, an attorney would know this better, you can't use the excuse of, "No one at this firm is morbidly obese."  That's a term that I've heard used, to describe someone who was extremely overweight.  They are at the point of risking death by being that overweight.

Again, if you really believe that this is the case, consult an attorney and see what they have to say.  Find out what it would take to prove your case if the issue is about you being extremely overweight.  See if that would allow you to become a part of a "protected class" under state or federal law.  If you live in a bigger city, you might be protected under local law, as well, because those laws are added on top of the original federal law.

I'm sorry to be more specific, but I think this becomes a way to evaluate whether this is a case of discrimination and whether firms can do it.

EP 1048 There has been no response to emails or instant messaging. I don’t want to bother my boss. Why aren’t they getting back to me?

Summary

I was asked, "How do I get a recruiter to respond to a salary negotiation?"

The person has been an intern and they have made an offer to them.  The recruiter for this firm hasn't been responding to emails or instant messaging and the intern is frustrated.  They want to find out how they can reach this person for negotiating.

Here are a few points:

As an intern who is converting to full-time staff, you are small fish on their plate.  I have other, more important fish to fry, too.  HR has a lot of things on their plate; they have hiring managers who are demanding service; they are interviewing; they are trying to fill positions; they are writing a heads… There are many things that HR is doing… You are not a big concern for them.
This HR person may be out of the office.  They may be traveling. They may be doing campus recruiting, hence why they may not be responding to you.
You are right not to trouble your boss.  This is not a major priority.  If the rule, they offered you a job  and you have already done parts of this job before.  They will probably be asking themselves, "What's the big deal?  You knew what the price point was we brought you want for this internship?"
They just don't care.  There's no point or concern that they have, because, after all, it's not like you're the only intern on the planet or qualified to do this job.  There are others. Their desire to negotiate is really small.
Let me summarize for you where you stand.

On the one side there is a rock. On the other side, there is a hard place.  You are somewhere between the two.

If your goal is to just make the connection and they are not respond, send an email to HR with the subject line, "Are you okay?"  The message may read something along the lines of, "I have emailed and I am do you and had not received a response.  I have a few questions about the job offer.  Would you give me a call, please?  I just want to make sure you are okay?  My experience of you is that you would normally get back to me but since I haven't heard, I just want to make sure that you are all right."

That will usually "guilt them" into surfacing.

EP 1266 Things can wrong in many places in your job search. 

Summary

You're involved with a job search. It's just not working for you. How do you critique what's going on in order to figure out what to course correct? Right?
It's very rare that a job search goes in a perfectly straight line with absolute progress and you wind up in a job instantly. Often the situation breaks down. So let's look at how to dissect it
If you're sending out resumes, and you aren't getting any interviews, you've got a resume problem. The resume isn't working for you. How you aresubmitting it isn't working for you.
If you're not even getting phone calls about resumes that you've posted on job boards, the issue may be one of two things. It could be the career that you've chosen for yourself isn't particularly marketable or, more likely, your resume is not keyword rich in the kind of skills that recruiters are looking for. You may need to change the language on your resume.
If you're getting calls for phone interviews and aren't being invited in, you've got a problem with phone interviewing. You just don't know how to do it well enough to entice people to want to continue the conversation. So,you need to improve on that. There are many different ways. I have a bunch of the posted as JobSearchCoachingHQ.com. But I'll simply say that you need to improve your phone interview.
If you getting phone interviews, being invited in for in-person ones and not getting asked back, you don't interview well in person. That could be caused by a variety of things too numerous to really mention here but that's where the breakdown is occurring. If you're getting invited back for finals and not getting past "the boss of bosses," you know "the Don" for the organization, the person to whom this job ultimate the reports, not the immediate manager, but the over "the overlord," you're not making connections with people, certainly not at the high levels.
And if you're getting offers and you're getting low balled,you haven't done a good enough job on your interviews to make them believe that you can solve their problems. So, they're basically tossing a bone at you and seeing if you'll bite. You haven't made them fall in love yet.
So this is how a job search gets deconstructed. There are obvious paths along the way and often people go through the process of just going through the motions.You know, they send out resumes. They don't prepare for phone calls. They haven't really keyword optimized their resume to make it attractive on job boards. They're flipping resumes across the transom like they're burgers at a fast food restaurant. How well does that work? Do you find them tasty? No, of course not. Neither does the employer. You're a spammer.
And if you're interviewing and not practiced for it, it's your fault, again. You haven't done the homework necessary to impress people all at all.

I call is video, “the faster FASTEST way to find a new job” and it really is the fastest way. It can have a slight delay, hence why did the faster piece at the beginning but really it’s the fastest way to find a new job.

Okay, here goes.

Once you have decided it's time to look at other things, I want you pick up the phone and call your former boss, that man or woman that you worked for before who is now off at another organization and just simply say, “Jeff, I’ve decided it's time to move. I really loved working for you. I learned a lot from you period I had a great experience with you. I was so disappointed when you left. I understand everyone as to make professional choices, but I really miss working for you. Can you use me in your group, in your team (however you would want to describe the environment that you be working in).”

They may say, “YES” or “I can’t use you right now. Could you hold out for a couple months? I have a knew budget coming in,” or “I could take you on a September as a contractor initially, but then I can bring you on to staff.”

They may say, “I don’t think this is the kind of place . . . I I don’t think I can use you. I’m fully staffed and I have a great team here.”

“Is there someone in your organization that you could point me to or introduce me to who might be able to use someone like me?”

Hence, this really is cutting the line. It's getting into the situation very quickly and seeing if … I’ve seen so many people over the years been able do this over the years. You know the story, too.

So, instead of being a nice boy a nice girl and applying for jobs through human resources, just go to an old boss that you liked working for and see if this tactic will work. If it doesn’t, hey, it was one phone call and it took seven minutes.

They may remember at a point when they hear about something and come back to you, but, the end of the day, this really is the fastest way to find a new position.

EP1256 The economy has begun to change. Swim with the river and survive or swim against the current and eventually drown.

Summary

In returning from vacation, I decided to change the format of the show from one where I was finding people to interview to one where I share my advice and advice more freely than I was allowed to previously.

Every day, Monday through Friday, 5 to 6 minutes, 10 tops, you'll be getting job search advice for me to help you find work more quickly.

This is the first show as I return and is not just simply design to help you earn additional income, but to head off any sort of difficulties you might have during the next recession. That's because I believe the economic framework in the United States has changed… Let me make my case to you.

If you have been paying attention, you've missed something that has been changing structurally in the US economy. That's the change to part-time work that has become so prevalent.

If you take a look at the recovery (this isn't a criticism of government policy or anyone politically), this is just an observation about how business has learned to cope with (1) the opportunities caused by changes in technology and (2) they'll see the value in hiring full-time workers anymore.

What's been happening more and more frequently is that companies are hiring part-time workers. That's in the government statistics. Some of the gets buried in the notion of the U-6 report where the statistic talks about people who would like to work full time but are actually working part-time.

I question that a little bit now; part-time can be broken up into two categories. One is part-time workers; the second is the new gig economy. Free agents. Freelancers. People who are working whatever hours they need to in order to do a particular task.

Some might fall under the category of virtual assistants; some might be web designers who are working on an individual project. Writers, editors, a whole host of people. Recruiters. Coaches. People who are doing particular functions for specific people.

They are not working 40 hour work weeks. Some are working less; some are working more. Some may work 40 hours. They are self-employed individuals were part of this new gig economy.

What I expect is going to be happening with the next downturn is that this is going to be ingrained in the culture and ingrained in our society that much more.

If you think about it, if your business right now, you're the headquarters building, you have buildings around the world where you are employing people. You are paying for benefits; you're paying for that building; you're paying for air conditioning and heat, for phone lines and computer systems… A variety of different additional things.

You are doing this even though you might need these people for a limited number of hours per week, a month or a year.

More and more firms, both small and large firms, and start to look at contractors, gig workers, people who are hired to perform a particular task. These people do it, are paid and move on.

You may complain, "Oh, it's these people in India again, or in China or wherever." But, you know, let me use myself as an example.

As I work on launching JobSearchCoachingHQ.com, I started looking at having some videos and the cost of having videos edited in the US was more than 10 times the cost of outsourcing it abroad. What would you do? You are buying close the made elsewhere. Don't criticize me; you are doing the same thing except to do it with your clothes, your food and many other things.

That's the trend I really see getting ingrained. Now, how does this affect you?

I want you to start thinking about things that you can do on the side or things that are part of your knowledge base that you can break apart that would create income for you in case the next recession, in case the next economic downturn or catastrophe affects you. Start now.

You can do research on sites like freelancer.com or upwork.com (that's a successful company to elance.com and odesk.com) in any number of other sites where there is information and experiences with gig workers.

Thank you from the standpoint of what special skills you have that, if you were marketing yourself and your knowledge, how you would sell yourself on a contract basis.

So, for example, if you are an accountant, you might the tax returns. If you are an engineer, you might do design work for different people. If you are a programmer, you might write specifications or design documents.

What is it that you do that can be broken apart into component parts and marketed?

Go to the sites and just do it from the standpoint of research. Take some time to proactively think but don't delay starting because gigs are going to be much more the norm in the future.

When I look at myself, my own background, and the work recruiters are doing, I am seeing more and more firms hiring contract recruiters, I am seeing sites that are paying for hourly work from recruiters. For example, there is one site I've seen where a recruiter sets the price (I have seen as low as $25 per hour in the US) for recruiting work. They are not paid a fee at the backend; they are hired to source, find and refer.

It's happening everywhere, folks. You need to be ready for it. If you are an administrative assistant, obviously, you can do virtual assistant work.

Start thinking ahead. Start laying the foundation for doing work for others on a part-time basis NOW. That way, if the economy craters, if the recession hits, if you lose your job, you have the financial wherewithal to last until you find your next job. That may take longer than you think.

Summary

The question is, “Is having a LinkedIn profile still relevant?”

Usually this question is asked by a younger professional, a recent grad, not a lot of experienced individuals, those kind of people. So, I want to speak to you in terms of investing.

If I told you putting two dollars a day aside had any sort of meaning you might scratch your head and go, “Two dollars a day? What’s that going to do for me?” Well, if you had zero interest and put down two dollars a day, you would have over $700 at the end of the year. You would have over $1400 at the end of two. And you have 3500 at the five. This might get your attention.

LinkedIn is kind of like that, as well, in that the investment in time and effort in a LinkedIn profile and becoming involved on the site pays off big dividends later. Here's how.

Recruiters are basically looking for people to fill jobs. That's corporate and third-party recruiters. So, both are on LinkedIn looking for backgrounds to fit jobs. So, you start getting messages from firms are trying to hire. So, you have to think of your profile in terms of SEO. Thus, you keyword optimize your LinkedIn profile to draw attention to yourself. You become involved in groups and you start doing networking online through LinkedIn.

The investment in time and effort pays off at times when you really need to make a change. Like, if you think you are going to get laid off in the next 30 years of your career, 40 years of your career, trust me. You are wrong.

So, making the investment NOW in building your profile out, keeping it up-to-date, regularly (like at least twice a week), take the app, logon, see if anyone's trying to reach you. Do that regularly and you are going to get tantalized by some of the jobs that people present to you.

Opportunity is going to knock and, even if you're not interested, you can start building relationships with people just by basically responding say, “Thanks. Not really a good time for me to change jobs right now. Keep me informed of other things. Okay?”

Doing that is how you, in the current economy, I'm not saying five years from now it might not be different, but for now, LinkedIn is the place to be for job hunters. Don’t miss out.

EP 1280 When hiring, are you allowed to deny people on a bad personality?

Summary

"When hiring, are you allowed to deny people on the bad personality where, if they don't embody the company image, even if they meet the paper requirements."
I want to break this question down into a couple of different components.  The basis of the rejection is your personality, not whether you have the skill… The company image… I'm confused about that but I will try to sort through as I talk.

Discrimination exists, under US law, based upon a number of criteria.  Some states have added additional criteria onto the initial federal wants.  As long as the form of discrimination. Any of those laws, it is not, by definition, discrimination.  It may be discriminatory. It may reflect ignorance, but it is not legally discrimination.

In this example, a person meets the paper requirements and we don't know whether this person displayed their knowledge poorly on the interview.  We are just going to look at what we know here.  This person believes that they were turned down based upon personality and a 2nd criteria.

Personality is not a discriminatory category under any criteria I've ever heard of.  Firms are allowed to evaluate people for "fit" as long as that doesn't fall into a discriminatory category.  For example, we don't think you fit in because we only hire men.  Another example would be your gay and we only hire heterosexuals.  And, of course you are black and we are white or your white or black.  What do you know about our culture without actually giving them a chance to demonstrate that in the course of the interview?  That would be clear discrimination based upon it. Personality… No.

Company Image?
I had a question based upon the phrase, "the company image."  They don't embody "the company image."  I'm wondering whether this is a question about weight and whether this person might be profoundly obese, for example.  In certain states, that behavior might qualify as discrimination.

Ultimately, you have to prove that was the criteria for being rejected by this organization.  That is a hard road to take.  In terms of weight, to my knowledge, an attorney would know this better, you can't use the excuse of, "No one at this firm is morbidly obese."  That's a term that I've heard used, to describe someone who was extremely overweight.  They are at the point of risking death by being that overweight.

Again, if you really believe that this is the case, consult an attorney and see what they have to say.  Find out what it would take to prove your case if the issue is about you being extremely overweight.  See if that would allow you to become a part of a "protected class" under state or federal law.  If you live in a bigger city, you might be protected under local law, as well, because those laws are added on top of the original federal law.

I'm sorry to be more specific, but I think this becomes a way to evaluate whether this is a case of discrimination and whether firms can do it.
