This is an issue that is going to show up more frequently and most people don’t address it and wind up in trouble.

I was hired for a remote position, I was hired for a hybrid job. Now they want me in the office exclusively. No more remote, no more hybrid. Am I screwed?

The short answer is yes, but. The but is at the time you receive an offer, you have the opportunity to negotiate special terms that indicate that this is a position where you’ve been hired to work remote or work hybrid and if that changes, you can either be a entitled to remain under that work condition, or be. There are specific severance terms for you, because they’ve changed the terms of employment and those are not acceptable to you.

The reason that that has to be part of the writing is that most of you work in at will environments. That is employers can pretty much do what they want, and can claim that there are special circumstances that have changed and now they want you in the office. So, if you’re willing to go to the mat for this, you should, or you should do it at the time you’re getting the offer.

Remember, unless it’s in writing, there’s no proof of any agreement, so that your manager says, ‘Oh, no problem. This is always gonna be remote.’ And there’s nothing about that in the offer letter. You’re out of luck, because there’s no proof.

So at the time of the offer, that’s the time to negotiate this. And if they don’t want to do that, take that as a message and you should get another firm to hire you under the terms that you want. But recognize you’ve spent a lot of time and energy, and now it’s going to blow up at the end. You may be upset about that. But would you be upset if you were on board and now they said, ‘we need you in the office five days a week. And sometimes it’s going to be a six, too,’ Of course you would be.

So deal with it at the time of the offer. Get special terms written for yourself. It has to be in writing, even if it’s the terms of your severance, where there’s X number of weeks that you’re going to receive in terms of compensation for the fact that they changed the terms.
