Can I Be Fired Without Warning? | JobSearchTV.com

By Jeff Altman, The Big Game Hunter

Fired. Terminated. Excessed. RIF’d, Axed. Whatever you call it, can it happen to you without warning?

What to Do If You’re Fired From Your Remote Job

Can I be fired without warning? The answer to that simply is yes. The exceptions are, if you have an employment contract or union contract that alters the at will relationship that you as an employee have with your employer, they can end the relationship at will.

That means your employer doesn’t need to have any cause to fire you. It means they don’t need to show you engaged in any serious misconduct. You can get fired because you didn’t get along with your boss. Your employer can fire you because you’re late too often. Your employer can fire you because they want to eliminate your position. Employers are not legally required to have a reason to fire employees.

However, even in California, there are situations where lying about the reason they’re firing you can, shall we say, indicate that they’re withholding a reason and may have discriminatory intent. So I’ll simply say to answer the question, yes, they can fire you for any reason. It’s good if they tell you what the real reason is, which can be as simple as ‘we don’t have enough work for you so we wish you well, but we can’t afford to pay anymore.’ But they don’t have to give you a reason ahead of the termination.

Them not having to give you a reason it’s the problem with the employment Force now. There needs to be a law set in place for all 48 states that says that an employer has to go through steps of disciplinary action before they can terminate which means they would have to have a verbal warning and at least three write-ups for any specific thing before they can fire you. That’s the problem now and they can fire you for discrimination and just claim they’re firing you for something else. It’s sad at the world we live in. When you can be fired without a verbal warning or write-up slip
