    um, also avoid “can’t be poached by a co worker or client” agreements as well.. but usually those are part of the hiring process….if you want the job, you sign it. During times when it’s ard to find people, they have options, when things are a little less robust…not as many options.

      Usually, those are not disclosed. I think of situations where firms collude to avoid that from happening, “I won’t steal your people if you won’t steal mine.” In consulting, it is obvious in the agreement that says, you cannot go to work for a client you’ve been assigned to by us for a period of 1 year after the assignment ends. This is different than an agreement that says, “You will not go to work for any client.”
